DR. OLALEYE’S TRIAL: EXPERT SAYS SURVIVOR HAD BRUISES AND CUT ON HER PRIVATE PART

A witness in the ongoing sexual abuse trial of Lagos Medical Doctor, Olufemi Olaleye, has testified before an Ikeja Special Offences and Domestic Violence court that it was discovered during investigation that the child victim had bruises and cut on her Vagina.
Dr. Olaleye the Medical Director of Optimal Cancer Care Foundation is facing a two-count charge bothering on defilement and sexual assault by penetration of his wife’s niece.
The witness, Dr. Akinwunmi Oyadipe, while giving her testimony, told the court that the survivor and her Aunt, Mrs. Aderemi Olaleye, who is the defendant’s wife, reported the case to her office at Mirabel Centre, in March 2022 and also, that the defendant repeatedly abused the child sexually since the middle of 2022.
The Deputy Public Prosecuting Counsel, Mr. Babajide Martins, lead the witness through the testimony.
Dr. Oyadipe, who is Medical and Forensic Expert, told the court that she listened to the girl’s story and also, carried out a medical examination on her.
She said, “The girl narrated that Dr. Olaleye, told her to suck his penis.”
“Sometimes, he would apply lubricant on her vagina and then penetrated her. He also gave her pills to take after the encounter and then threatened her.”
She mentioned that after her findings, it was confirmed that the girl experienced a forced penetration.
During Cross-examination, the defendant counsel, Babatunde Ogala, asked the witness if she could confirm through her findings whether the defendant actually committed the offence. She said. “No” because she wasn’t there when the incident happened.
Mr. Ogala, then asked if she could confirm when the girl had her first sexual penetration.
She answered that medically, she cannot confirm that but added that their findings were consistent with the person that had experienced a constant forced penetration.
Earlier in the proceedings, a police officer identified as Investigating Police Officer, Esther Ngozi Igheneweka, of the Police Gender Unit testified that she took part in the investigation of the matter and the case was first reported in March 2022.
She added that after the complaint was received from the defendant’s wife, Mrs. Aderemi and her statement, the survivor, their gateman and the defendant’s statement were also taken,
According to the IPO, the defendant denied the allegations against him when he was brought to the station for questioning. “We detained him for further investigation,” She said.
“We took the victim to the places where she alleged that the defendant had been molesting her which included their sitting room. The medical report we saw that time showed recent forceful penetration,” She added.
She however, told the court that she found out that the survivor did not report the case to anybody until March 29, 2022.
The Police officer also, confirmed that the matter has been reported to Anthony Police Station, while adding that the investigation was not completed because, the complainant travelled out of the country and they didn’t continue the case since then.
During cross-examination, the defense counsel, Babatunde Ogala, asked the Police officer, if she requested for the CCTV footage of the scene of the crime. She responded that she requested for the footage but never watched it.
The defense counsel further asked, “Dr. Olaleye, wrote in his statement that when the girl came to their house, she said she she was 18 to 19 years. Did you investigate the matter?”. The officer said “NO”.
He then asked if she didn’t complete the investigation because the complainant travelled out of the country, The officer answered “YES”, that the case was put on hold pending the time that the complainant would return. She added that the complainant was communicating with her while she was away.
When answering another question from the counsel on how the Ministry of Justice got to know about the case, she answered that she didn’t know how the Ministry got to know about the case or why they demanded for the case file.
Upon hearing the testimonies from the witnesses, Justice Ramon Oshodi however, adjourned the case till January 26, 2023 for continuation of trial.
Hotjist.com, earlier reported that the court had remanded Dr. Olaleye, in custody pending the time he would meet his bail condition.
When the proceeding took place in December, 2022, his wife had testified against him before the court stating that he was always giving her sleeping pills in other to carry out his evil act of molesting her niece.
She also, mentioned that her husband was a sex addict who should not be allowed in the society as he could be a great danger to the people.
Mr. Babajide Martins, the DPP however, told the court that the prosecuting team has one more witness to present before the case would be concluded.
