(UPDATE) LAGOS GOVERNORSHIP POLLS: JANDOR SEEKS TRANSFER OF APPEAL TO ABUJA

Abdul-Azeez Olajide Adediran, also known as Jandor, is the Peoples Democratic Party’s (PDP) candidate for governor of Lagos State in the 2023 election. He has requested that Justice Monica Dongbam-Mensem, the President of the Court of Appeal, move the appeal hearing to Abuja.

In a letter dated October 23, 2023, Jandor claims that this move will guarantee impartiality and fairness, free from possible intervention on the part of Justice Dongbam-Mensem. At the Court of Appeal President’s office, the notice was received that same day.

Recall that Judge Dongban-Mensem moved all pending election petition cases from the 36 states to Abuja and Lagos as part of his efforts to stop political meddling in the legal system.

With this change, special panels in the two states, rather than the court’s 20 divisions, will now hear all appeal cases pertaining to governorships, as well as national and state assembly elections originating from tribunal judgements.

Special panels composed of national justices convene in Lagos to hear appeals from the southern region of the country; special panels convene in Abuja to hear appeals from the northern region of the country.

Jandor challenged the State Election Petition Tribunal’s ruling from September 25th with a notice of appeal on October 13th, citing 34 grounds.

The 38-page paper was submitted by Clement Onwuenwunor (SAN) and his legal team.

The notice of appeal included the following respondents: the All Progressive Congress (APC), the Independent National Electoral Commission (INEC), Governor Babajide Sanwo Olu, his deputy, Obafemi Hamzat, the Labour Party (LP), and Gbadebo Rhodes-Vivour, the party’s candidate.

The PDP candidate and his party also restated the reliefs requested in their petitions, requesting the disqualification of the LP and APC candidates on the grounds of appeal.

Additionally, Jandor wants the Court of Appeal to rule that because the candidates and the APC were ineligible to run in the election, all of the votes cast for them and the APC in that particular election were wasted.

And that he is the legitimately qualified candidate to be declared the election’s victor, having received the third-highest number of votes in the contest and fulfilling all requirements outlined in the Electoral Act of 2022.

that INEC shall immediately provide a Certificate of Return to the appellant, DR. AZEEZ OLAJIDE ADEDIRAN, as the legitimately elected governor of Lagos State, and that the Certificate of Return given to Sanwo-Olu is null, void, and of no consequence.
