….Orders Removal of Two Floors Illegally Added to Building Under Construction in Ikeja
Dr. Oluyinka Olumide, the Commissioner for Physical Planning and Urban Development, has reaffirmed that the State Government will not tolerate unlawful development or violations of laws pertaining to physical planning permits.
He stressed the need of upholding law and order and establishing a secure and well-organized environment for all Lagos citizens, saying that the Lagos State Government is committed to taking tough measures against illegal development activities in 2024 and making sure that the Physical Planning Permit Laws are strictly followed.lag
The Commissioner made this statement in response to the start of monitoring and enforcement operations in the State’s Ikeja Area by representatives of the Lagos State Physical Planning Permit Authority (LASPPPA), under the direction of Tpl. Kehinde Osinaike, the organization’s general manager.
Dr. Olumide expressed particular dissatisfaction with a building that is currently under construction at Isaac John by Oba Dosumu Street, GRA Ikeja, across from the Radisson Blu Hotel. The developer of the building was given permission by the Authority to build a six-story mixed-use building with a basement, but they illegally added two floors to the already-existing building.
The Commissioner denounced the Developer’s lawlessness, saying that despite receiving multiple infringement notifications, the Developer did not comply or seek explanation from LASPPPA. As a result, he issued an order to reseal the building and declared that the construction was no longer covered by the LASPPPA, the authorizing authority, and that the planning permit that had previously been given for it was no longer valid.
Before the building may be opened, the Commissioner urged the developer to either remove the two illegally added stories or comply with all connected criteria for the property to be regularized.
The Commissioner emphasized that it is crucial to make sure that physical development operations are carried out with strict adherence to the current Physical Planning Laws and Regulations of Lagos State in light of the illegal activities carried out at the aforementioned address.
He claims that the revocation of a planning permit is prescribed by the Physical Planning Permit Laws and Regulations of Lagos State 2019 as amended, in cases where the developer has developed beyond the approved amount and has added, changed, or modified development without first obtaining the necessary paperwork from the approving office.
While observing that illegal development has been a persistent issue in the state, leading to environmental degradation, congestion, and other challenges, Dr. Olumide maintained that by enforcing the Physical Planning Permit Laws, the government will be able to address these critical issues and promote sustainable urban development.
Dr. Olumide averred that the government will not tolerate any violations of the laws and will take necessary actions against those who engage in illegal development activities. “The Lagos State Ministry of Physical Planning and Urban Development will work closely with relevant agencies to identify and penalize offenders”, the Commissioner assured.
However, Olumide disclosed that the government intends to expedite the physical planning permit application process in addition to toughening up on illegal development. This will enable individuals and organizations to pursue their development projects with ease and in compliance with state regulations.
