ALLEGED FRAUD: COURT STRIKES OUT MOMPHA’S SUIT TO VACATE EFCC’S ARREST WARRANT
On Monday, the Federal High Court located in Lagos dismissed a lawsuit brought by internet sensation Ismaila Mustapha, also referred to as Mompha, who wanted to overturn an order that had been placed for his arrest.
Mompha’s lawsuit was dismissed by the court’s judge, Justice Ayokunle Faji, for inadequate prosecution.
In the lawsuit that his attorneys filed, Mompha, who is currently residing in Dubai, United Arab Emirates, requested an order from the court directing the Economic and Financial Crimes Commission (EFCC) to rescind the request that it made to the ICPO-INTERPOL in March 2023 for his arrest. This was because the anti-graft agency had either failed or refused to provide the ICPO-INTERPOL with specifics regarding the allegations that were made against him.
He presented his request in accordance with the court’s inherent jurisdiction as well as Order 26 Rule 1 of the Federal High Court (Civil Procedure) Rules.
Mompha did not appear in court or have legal representation during the matter’s Monday-resumed hearing.
Sulaiman Sulaiman, the EFCC’s attorney, requested that the lawsuit be dismissed due to a lack of assiduous prosecution.
Sulaiman told Justice Faji that since the complaint was filed in 2023, neither the applicant nor his attorney had appeared in court to pursue the case, and he was pleading with the court to have it dismissed.
Following Sulaiman’s submission, the court reviewed the documentation and granted the EFCC attorney’s motion to dismiss the lawsuit.
