COURT DISMISSES MAMU’S REQUEST FOR TRANSFER FROM CUSTODY OF DSS
The appeal by Mohammed Tukur Mamu, the suspected terrorist negotiator, to be moved from the Department of State Service (DSS) to the Kuje Correctional Centre was denied by Justice Inyang Ekwo of the Federal High Court in Abuja.
Justice Ekwo rendered the decision on Monday, stating that the Federal Government had cited persistent jailbreaks as a primary justification for opposing Kuje’s transfer request.
The judge further stated that Mamu did not, as required by law, refute or contest the averments.
The judge held that the averments are considered facts since Mamu did not contest them, and admitted facts do not require more evidence.
After then, the judge mandated that Mamu stay in DSS custody until he was tried for the offences against him.
On the other hand, Justice Ekwo upheld his previous ruling that he should be permitted to see his doctor under the DSS’s supervision for medical care.
Mamu had claimed on April 29 through his attorney that the DSS was not abiding by the court’s December 19, 2023, order granting him access to his doctor for medical care.
The accused terrorist negotiator stated in his notice motion that he was given permission to see the doctor once and that during that visit, a report of a thorough medical examination was completed and sent to the DSS.
Since the submission of the report, Mamu alleged that the physician had not been allowed to have access to him and that he needed urgent surgical operations in any hospital in the country.
The defendant further claimed that his health had since deteriorated and that he may die if he was not moved out of DSS custody to Kuje Prison.
He promised regular attendance in court, adding that he can only stand trial when alive.
Mamu was arrested at the Aminu Kano International Airport upon his arrival from Egypt on September 6, 2022, over his alleged relationship with the terrorists who attacked the Abuja-Kaduna train on March 28, 2022.
The DSS, on March 21, 2023, arraigned him on 10 counts of terrorism financing, among others but he pleaded not guilty to the charges.
