COURT ADJOURNS SUIT STOPPING OSUN LG POLL TO JANUARY 17

The Osun State High Court, located in Ile-Ife, has postponed until January 17, 2025, the hearing of the remaining applications or a potential settlement report in the lawsuit contesting the state’s local government election process, which was held on February 22.

The lawsuit was brought against the Osun State Independent Electoral Commission, Governor Ademola Adeleke, and the State Attorney General by the All Progressives Congress and 19 disqualified candidates.

Citing exclusion from the poll and other irregularities, the plaintiffs are attempting to stop the elections.

Mr. Muhydeen Adeoye, the claimants’ attorney, is requesting two main reliefs: include the disqualified candidates in the poll if it goes on and nullifying the modified election notice that OSSIEC released on July 18, 2024.

Monruf Adediran, the attorney representing the All Peoples Party, attempted to join the lawsuit during Thursday’s session, which was chaired by Justice Adedapo Adeniji.

Mr. Deji Atoyebi, the State Attorney General’s attorney, asked for additional time to address the application, though.

In the meantime, Mr. Musibau Adetunbi (SAN), the attorney for OSSIEC, suggested an out-of-court settlement.

He recommended that OSSIEC reevaluate its decision to reject the candidates’ nominations, and that the claimants withdraw their reliefs contesting the modified election notice and the lack of an Election Petition Tribunal.

Adeoye indicated his preparedness to deliver his clients’ decision at the upcoming court session by acknowledging the urgency of the situation and promising to counsel them on the proposed settlement.

Justice Adeniji’s decision postponed the case to January 17, 2025, so that the outstanding applications or settlement report may be heard.

Adeoye expressed optimism, stating, “We will consult thoroughly with our clients and return with a firm position. The APC leadership in the state, led by the Minister of Marine and Blue Economy, Mr Gboyega Oyetola, is fully behind us in this legal battle.”

Adetunbi, speaking in a similar vein, emphasised the importance of fairness.

“Our primary goal is to ensure justice for all parties. We’ve made a proposal for settlement, and if it is accepted, great. If not, we are prepared to continue the legal process,” he said.
