JUST IN: JULIUS ABURE REMAINS NATIONAL CHAIRMAN OF LP, APPEAL COURT DECLARES
Julius Abure is still the national chairman of the Labour Party, according to a reaffirmation from the Court of Appeal Abuja.
In a ruling delivered by Justice Hamma Barka, a three-member panel of the appeal court ruled that its November 13, 2024, ruling, which acknowledged Abure as national chairman, remains in effect and has not been overturned by any court.
While rendering a decision in two distinct appeals submitted by Senator Esther Nenadi Usman, the Independent National Electoral Commission (INEC), and the caretaker committee, Justice Barka made the statement.
In the two distinct appeals, the appellate court ruled that it refrained from delving into the Labour Party leadership dispute because it is not a justiciable matter.
According to the appellate court, anything that is done outside jurisdiction amounts to a nullity. Hence the judgement of the Federal High Court delivered on October 8, 2024 by Justice Emeka Nwite is of no effect because it was delivered without jurisdiction.
While striking out the suit for want of jurisdiction, he held that the appellate relied on its previous judgement of November 13 last year to hold that “Abure Remains National Chairman of the Labour Party”.
