COURT DISMISSES APPLICATION FOR CHANGE OF COUNSEL IN OBASA REMOVAL CASE

The Lagos State High Court has dismissed an application seeking a change of counsel representing the Lagos State House of Assembly in the ongoing suit filed by the reinstated Speaker, Mudashiru Obasa, challenging his removal.

In its ruling, the court affirmed that Femi Falana (SAN) remains the competent and duly authorized counsel to represent the House of Assembly, the first defendant in the case. The judge also noted that the suit filed by Olalekan Onafeko, challenging his suspension as the Clerk of the House at the National Industrial Court in Lagos, is still pending, and emphasized that it would not delve into the substantive issues raised in the current application at this stage.

Olusola Idowu (SAN), the lead counsel seeking to take over from Falana, had argued that the House had the inherent right to change counsel at any time. Idowu also referenced a National Industrial Court order for the reinstatement of Onafeko, who, according to him, had briefed a new legal team to represent the House. However, Falana countered that he had not been debriefed by the House, and pointed out that the Industrial Court had since denied issuing any order for Onafeko’s reinstatement.

In addition, the court struck out applications from the 1st and the 3rd to 35th defendants, who had sought a stay of proceedings pending the outcome of their appeal.

The court is currently hearing other pending applications related to the case.
