KADUNA COURT DISSOLVES SIX-YEAR-OLD MARRIAGE OVER BATTERY

On the basis of violence and threat to life, a Customary Court in Kaduna on Thursday dissolved the marriage of 37-year-old businesswoman Hannah and her husband Caleb Williams, who had been married for six years.

Judge Dauda John declared in his ruling that the marriage had irretrievably broken down and ordered its breakup.

“No one should be forced to stay in a toxic marriage, and the wife deserves peace and emotional relief.

He believed that the two parties’ marriage was irreparably shattered and that they shouldn’t continue living together, especially since it was almost a death threat.

John declared, “Thereby, the marriage between the two is dissolved with effect from today, April 10.”

In addition, he ordered the mother to return the N50,000 dowry that the respondent had paid and gave her custody of their 5-year-old kid.

Hannah, the petitioner, had previously told the court that she could no longer remain in the marriage due to ongoing abuse and threats to her life.

She said that after they lost their second child three years ago, her husband had made their six-year marriage extremely difficult for her.

“My lord, I can no longer bear the emotional and physical abuse, as well as maltreatment.

Whenever I try to talk to him about his behaviour, he will lash out at me and tell me if I am tired of the marriage, I should leave.

She accused her husband of beating her to a stupor on many occasions until neighbours intervened, and while beating her, he would keep saying that she either left his house alive or dead.
