LAGOS STATE GOVT DECRIES ACTIVITIES OF LEGAL PRACTITIONERS ACTING AS COMMISSION AGENTS BETWEEN PROPERTY OWNERS, CLIENTS

The Lagos State Government has once again denounced the actions of legal practitioners who act as agents by collecting agency fees from clients and tenants on behalf of property owners.

This position was reiterated by the Special Adviser to the Governor on Housing, Barrister (Mrs.) Barakat Olawunmi Odunuga-Bakare, during an ongoing stakeholders’ engagement with professionals in the built environment.

Barr. Odunuga-Bakare clarified that the rightful role of lawyers in real estate transactions is to draft contractual agreements between property owners and prospective tenants—agreements that specify rental terms, duration, and payment conditions. She stressed that the responsibility of collecting agency fees lies solely with licensed commission agents, not legal practitioners.

She further warned that any lawyer found performing the duties of a commission agent will face disciplinary action through the Nigerian Bar Association (NBA).

Reaffirming the state government’s dedication to reforming the housing sector, the Special Adviser warned unregistered agents and individuals posing as professionals to stop charging arbitrary fees from tenants and unsuspecting members of the public. The government, she said, remains committed to restoring order and transparency in the real estate sector.
