COURT OF APPEAL OVERTURNS FEDERAL HIGH COURT RULING ON KANO LG POLLS, SAYS ONLY STATE COURTS HAVE JURISDICTION

The Court of Appeal in Abuja on Friday overturned a ruling by the Federal High Court in Kano that had nullified the composition of the Kano State Independent Electoral Commission (KASIEC) and the October 26, 2024, local government elections.

Delivering judgment, a three-member panel led by Justice Biobele Abraham Georgewill held that the Federal High Court lacked jurisdiction to adjudicate on matters concerning the composition of state electoral commissions, which fall under the purview of state high courts.

The appellate court upheld the appeals filed by the Kano State Attorney General, the Kano State House of Assembly, and KASIEC, ruling that the cases earlier decided at the Federal High Court were invalid due to lack of jurisdiction.

In a related judgment, the Court of Appeal also reversed another Federal High Court decision that had rejected the list of candidates submitted by a faction of the New Nigeria People’s Party (NNPP) to KASIEC for the local elections.

The appellate court ruled that internal party leadership disputes and the selection of candidates fall outside the jurisdiction of the Federal High Court and should not be resolved through judicial intervention.

According to the panel, political party leadership and candidate nomination are internal affairs and cannot be determined by the courts.

Friday’s rulings are seen as a significant clarification of the jurisdictional boundaries between federal and state courts, especially concerning electoral matters at the state level.
