
GOMBE POLL: SUPREME COURT DISMISSES ADC’s APPEAL AGAINST GOV YAHAYA’S ELECTION
…Fixes Friday for judgment on PDP’s appeal
The Supreme Court has dismissed the appeal filed by the Action Democratic Congress and its candidate, Nafiu Bala against the election of Gombe State Governor, Inuwa Yahaya of the All Progressives Congress.
This is as the apex court fixed judgment in the appeal filed by Muhammad Barde of the People’s Democratic party against the governor for Friday.
The election petition tribunal and the Court of Appeal sitting in Abuja had affirmed the election of the Gombe governor.
Not satisfied with the verdicts of the lower courts the two parties and its candidates approached the apex court.
At the proceedings on Wednesday, counsel for the ADC candidate, Herbert Nwoye denied a claim that his brief was filed outside the permitted time frame.
He insisted that his brief was filed on January 2 due to the new year public holiday, adding that he was served with the appellant’s processes on December 29.
Justice Kudirat Kekere-Ekun who led the five-member said he had until December 31 to file his brief.
She also held that the judge held the ADC candidate had about 1,000 votes but was trying the overload the court with its case.
“You can’t come to court with frivolous appeal. I think you should not waste our time,” the judge said.
Justice Kekere-Ekun, however, urged lawyers to advise their clients on cases they bring to court.
Nwoye subsequently opted to withdraw his appeal.
Justice Kekere-Ekun dismissed the appeal.
The panel after listening to the argument in the PDP’s matter reserved till Friday.
