COURT RESERVES JUDGEMENT IN EL-RUFAI’S SUIT AGAINST KADUNA ASSEMBLY

In the lawsuit that Mr. Nasir El-Rufai brought, the Federal High Court in Kaduna State has deferred its decision.

The former governor of Kaduna State, El-Rufai, is attempting to have the report of the State House of Assembly’s Ad-Hoc Committee, which implicated him and his administration in a purported N423 billion fraud, revoked.

He had filed a basic rights complaint in June 2024, contesting the house report on the grounds that he was not given a fair hearing during the house’s sitting.

Through his attorney, Abdulhakeem Mustapha (SAN), El-Rufai is requesting in the lawsuit that the court declare the assembly’s report to be void.

The state attorney general and the House of Assembly of Kaduna State are the respondents in this action.

All of the respondents adopted their own procedures and asked the court to dismiss the lawsuit during the Thursday court session.

Mr. Femi Falana, SAN, the counsel for the Kaduna State House of Assembly, the first respondent, contended that the court lacked jurisdiction to rule on El-Rufai’s basic rights issue or to reject the Assembly’s report because of its constitutional mission.

In response, Sule Shauaibu, SAN, the Kaduna State Commissioner of Justice and a respondent in the lawsuit, submitted preliminary and substantive objections, arguing that the court ought to reject the case due to its lack of jurisdiction.

In addition, he requested that the major lawsuit be dismissed by the court due to its speculative nature and absence of a cause of action against the Attorney General.

Furthermore, according to both respondents, the applicants did not present the Kaduna State House of Assembly report to the court, which they requested the court rule was invalid and illegal.

As a result, they asked the court to dismiss the lawsuit as a whole since it was without merit.

Senior Nigerian barrister Abdulhakeem Mustapha, who represents Nasir El-Rufai, was not present in court. But after hearing from the suit’s attorneys, the presiding judge, Justice R.M. Aikawa, stated that the parties would be informed of the judgment date.
