COURT DISMISSES SUIT SEEKING TO REMOVE GANDUJE AS APC CHAIRMAN

Justice Inyang Ekwo of the Federal High Court in Abuja has dismissed a suit seeking to remove Abdullahi Ganduje as National Chairman of the All Progressives Congress (APC).

The APC North Central Group’s lawsuit against Ganduje was dismissed by the judge on a variety of grounds.

Justice Ekwo ruled that the APC North Central Group is not a juristic person and is not legally registered; therefore, it lacks the legal authority and competence to launch the complaint.

The judge also ruled that the plaintiff failed to investigate internal mechanisms for peaceful resolution of matters before rushing to court.

Justice Ekwo also ruled that the appointment of APC officers by the party’s National Executive Committee is an internal matter that no court may interfere with.

The Northern Central APC Group has taken Ganduje, the APC, and the Independent National Electoral Commission (INEC) to court, requesting that Ganduje’s appointment by the APC be nullified due to flagrant violations of the party’s Constitution.

The North Central APC faction alleged that Ganduje’s appointment violated Article 13 of the APC Constitution since it was not done through the democratic procedure outlined in the party’s laws.

The plaintiff, the North Central APC Forum, led by Saleh Zazzaga, filed the lawsuit to question Ganduje’s selection as the APC’s National Chairman despite the fact that he is not from the North Central geopolitical zone, which was supposed to fill the position.

The plaintiff in the complaint requested that the court, among other things, prevent Ganduje from continuing to represent himself as the APC’s chairman.

It further asked the court to impose an injunction instructing INEC not to recognise any activities made by the APC, including congresses, primaries, and nominations, since Ganduje became APC Chairman on August 3, 2023.
