REPS INSTRUCT CDS TO FREE MIYETTI ALLAH PRESIDENT, BODEJO

The Chief of Army Staff, Lt-Gen. Olufemi Oloyede, and the Chief of Defense Staff, Gen. Christopher Musa, have been urged by the House of Representatives to promptly free Bello Badejo from unjustified arrest.

In order to explain why officers under their command violated the pertinent provisions of the Nigerian Constitution, the Green Chamber also called Musa, Oloyede, and the Commanding Officer of the 177 Battalion to appear before the House Committees on Army, Human Rights, and Justice on Thursday, December 20, 2024, at 3:00 p.m.

Additionally, it ordered the military to apologize to Badejo for violating his fundamental human rights as protected by the constitution.

After a proposal introduced by Hon. Mansur Soro at Tuesday’s plenary was adopted, the House adopted the resolution.

In introducing the motion, Soro said that Badejo was taken into custody by Nigerian Army officials from the 177 Battalion in Maliya town, Nasarawa State, on December 9, 2024, in a commando-style operation without a court order or prior invitation.

He mentioned that several members of the Maliya community were allegedly misinformed by a retired military commander, which led to the arrest.

A week after the arrest, Badejo had not yet been charged before a court of competent jurisdiction, as required by current laws, which worried Soro.

He underlined that Badejo’s fundamental human rights, as guaranteed by Sections 34, 35, and 36 of the Federal Republic of Nigeria, 1999, amended Constitution, were being violated by the Nigerian Army’s officers’ ongoing incarceration of him without official charges.

The House made the following resolution:

– Condemn the attempt by the officers of the 177 Battalion to usurp the role of the Nigerian Police and the courts in resolving disputes between citizens.

– Call on the Chief of Defence Staff and the Chief of Army Staff to order the immediate release of Alhaji Bello Badejo from unlawful detention and to apologise to him for infringing on his constitutionally-guaranteed fundamental human rights.

– Invite the Chief of Defence Staff, Chief of Army Staff, and the Commanding Officer of the 177 Battalion to appear before the House Committees on Army, Human Rights, and Justice on Thursday, 20th December 2024, at 3:00 p.m. to explain why officers under their command violated the relevant provisions of the Nigerian Constitution.
