BREAKING: BRT DRIVER, ANDREW NICE SENTENCED TO DEATH BY HANGING

– Convicted for attempted rape, Murder of Ayanwola Oluwabamise, rape and sexual assault of two other women

The Lagos State High Court, Tafawa Balewa annex, has found Andrew Nice Ominikoron, a Bus Rapid Transport (BRT) driver guilty of the murder of 22-year-old Ayanwola Oluwabamise and sexual assault of one Dr. Anosike Victoria and has been sentenced to death by hanging by the neck.

While delivering judgement on Friday, Justice Sherifat Sonaike read that, Omnikoron was charged on five counts bothering on murder, conspiracy, sexual assault and rape.

On count one, he was found guilty of raping one Nneka Maryjane Ojiezelu and sentenced to Imprisonment for life. He was however discharged and acquitted accordingly on charge of conspiracy (Count 2).

On count 3, Omnikoron is not found guilty of raping Bamise Ayanwola, but is found guilty of a lesser offence of attempted rape and sentenced to 14 years Imprisonment.

On count 5, for sexual assault of of Dr. Anosike Victoria on 29th February, 2021, he was given a sentence of three years Imprison.

He was however, on count 4 sentenced to death by hanging for the murder of Bamise.

The judge said, “that for the death of Oluwabamise Ayanwola, you will be hanged by the neck until you are dead. May God have mercy upon you.”

Earlier while reading the judgement, Justice Sonaike, mentioned that the only reasonable inference the court can deduced from the case based on evidence available is that defendant murdered the deceased.

She also said the court holds that Omnikoron, caused the death of Bamise and was the last person to see her before her death on February 26, 2022, re-enforcing his guilt.

“The deceased died from severe cerebral injury and blood forced trauma an his actions and inactions led to her death.

The law established that the person last seen with a deceased bears full responsibility for death unless he gives explanation on how he has no hand in the death.

“In his evidence he admitted he was alone with her in the bus and where her body was dropped but failed to return to the place to help her instead, he ran away to a remote village in Ogun state without reporting the case.”

Justice Sonaike, said the prosecution were not able to prove beyond reasonable doubt the matter of rape of Ayanwola, but evidence showed that he sexually harassed young female passengers, put off the light in the bus and took unfamiliar routes, showing a clear well thought out plan with the intention to rape.

She said that, he intended to have sexual intercourse with the deceased, but her death must have ensued when she resisted rape.

Justice Sonaike however, held that the prosecution, the Lagos State Government, successfully proved beyond reasonable doubt that the defendant committed the offence of murder.
