DJOKOVIC WINS APPEAL TO STAY FOR AUSTRALIAN OPEN DESPITE BEING UNVACCINATED AGAINST COVID-19

Despite winning a legal battle to stay in Australia to compete in the Australian Open despite being unvaccinated against COVID-19, the government has threatened to cancel Novak Djokovic’s visa for the second time.

As he delivered his ruling, Judge Anthony Kelly overturned the visa cancellation, ordered the Australian government to pay legal fees, and released Djokovic from detention within half an hour.

The Minister for Immigration, Citizenship, Migrant Services, and Multicultural Affairs – not the minister who cancelled Djokovic’s visa the first time – will now decide whether to exercise a personal power of cancellation of Djokovic’s visa, according to government counsel Christopher Tran.

A transcript of Djokovic’s interview with Border Force last week was released shortly after the verdict, in which the world number one stated, “I am not vaccinated.”

The Australian Open begins on Monday, January 17th, with the draw on Thursday, January 13th.

Djokovic was released from detention earlier in the day to be with his lawyers during the hearing, and Judge Kelly expressed his displeasure with the denial of Djokovic’s medical exemption.

Djokovic’s lawyers presented their arguments to the court, but government lawyer Mr Tran only spoke for half an hour before a lengthy adjournment.
