INEC IS ORDERED BY THE COURT TO REINSTATE SOLUDO AND UBA AS APGA AND PDP CANDIDATES

An Anambra State High Court in Awka has ordered the Independent National Electoral Commission (INEC) to immediately publish the names of two governorship candidates for the November 6 election.

Senator Ugochukwu Uba of the Peoples Democratic Party (PDP) and Prof Chukwuma Soludo of the All Progressives Grand Alliance are the candidates (APGA).

Justice Obiora Nwabunike, who presided over the case involving Uba, Valentine Ozigbo, and the PDP, said the party erred by using “superdelegates” without first vacating an order issued by an Abuja court.

“With the evidence before me and having heard from parties involved in the matter, I rule that Ugochukwu Uba is the duly elected candidate of the PDP,” the judge said.

“It is not for nothing that court judges are referred to as My Lords. When a court makes a decision, it must be followed. It must be obeyed, no matter how stupid or ugly it is.

“As a result, it was incorrect for the PDP to proceed with the primary election at the Dora Akunyili Women’s Development Centre, which produced Valentine Ozigbo, with what they called super delegates against a live court judgment, without overturning the judgment.

“That action cannot be vitiated or mitigated by defence counsel’s argument that party primaries are internal affairs of political parties.

“I order that the INEC list Ugochukwu Uba’s name without further delay, and that the defendants pay a cost of N10 million to the applicant.”

In the other case, Justice C.C. Okaa reinstated Prof Soludo as the APGA candidate and directed INEC to publish his name as soon as possible.

The Court also ordered INEC to remove Chukwuma Umeoji’s already-published name and to stop presenting himself as APGA’s candidate.

Justice Okaa reaffirmed Victor Ike Oye as the undisputed National Chairman of the APGA and ordered Edozie Njoku and Jude Okeke to cease acting as APGA national chairman.

“The Victor Oye camp filed a case without informing the Jude Okeke group. We learned about it on Friday and quickly mobilized our lawyers to apply to join the case, but the judge refused because allowing the joinder would require an adjournment to allow for consequential changes to the processes to reflect the new names joined. Even though no lawyer in the case objected, the judge dismissed the motion.

“All state institutions must obey court decisions; that is the legal position.” After failing to deliver the judgment on Friday, the judge delivered a judgment this morning (yesterday) in a court surrounded by over 150 police officers and soldiers, and where everyone who was not a lawyer was chased out, and granted all of the applicants’ prayers and more.

“The Awka judgment cannot overturn the Jigawa judgment. They are courts with concurrent jurisdiction.

“They cannot change INEC’s position with it. Hopefully, this matter will be resolved soon and APGA will be at peace.”
