SUPREME COURT: “DISSOLVING ELECTED LOCAL GOVERNMENT COUNCILS IS ILLEGAL”

The dissolution of local governments in Oyo State was declared unconstitutional by the Supreme Court on Friday.
Their substitution with caretaker committees is also unconstitutional, according to the country’s highest court.


Justice Abubakar Malami (SAN), the Attorney-General of the Federation and Minister of Justice, had previously ordered Oyo State Governor Seyi Makinde to reverse his decision to dissolve local government administration in the state.

Prof. Oyewo Oyelowo, Attorney-General and Commissioner for Justice in Oyo State, received the order in a letter dated 14 January 2020.
“The common practice by some state governors in dissolving elected local government councils is illegal, null and void,” the AGF said, citing the Supreme Court’s ruling, which is binding on all 36 states of the Federation.
