
COURT ADJOURNS HEARING AS EMEFIELE, FG TACKLES EACH OTHER OVER CUSTODY, BAIL

Following two new applications from the banker and the Federal Government, the Federal High Court in Lagos will hear arguments about the legal custody of suspended Central Bank of Nigeria (CBN) Governor Godwin Emefiele on August 15.
The government’s first application, submitted on August 3, asks for permission to appeal Justice Nicholas Oweibo’s vacation judge order from July 25 that granted Emefiele bail.
The Federal Government is being asked to suspend prosecuting Emefiele on the accusation of illegal possession of a firearm and ammunition in the second petition, which he submitted on August 8.
After hearing the arguments from both sides, Justice Nicholas Oweibo fixed July 15 to hear the lawsuit in his decision on Thursday.
The Federal Government had requested that the court issue an order remanding Emefiele in the custody of the DSS rather than continuing to enforce the judgment remanding him in the custody of the Nigerian Correctional Service (NCoS).
Emefiele filed a second motion, asking the court to rule that he be cleared of all allegations brought by the government. He claimed that this is “brazen disobedience” to the court’s ongoing orders releasing him on bail on July 25, 2023.
He also requested a further injunction that would forbid the Federal Government from receiving any additional judicial favors unless and until it complies with the bail ruling.
