
JUST IN: A’COURT DISCHARGES AND ACQUITS DR. OLALEYE OF DEFILEMENT
The medical director of the Optimal Cancer Care Foundation, Dr. Olufemi Olaleye, was cleared by the Lagos Court of Appeal of the accusation of defiling his wife’s niece.
An Ikeja Sexual Offences and Domestic Violence Court found Dr. Olaleye guilty of raping his wife’s teenage niece and sentenced him to life in prison.
The prosecution’s case had been deemed strong by the trial judge.
For defilement and sexual assault by penetration of a minor, Dr. Olaleye had appealed his conviction and asked the appellate court to reverse his life sentence.
However, the trial court erred in condemning Dr. Olaleye based on “tainted” and “unreliable” testimony from his estranged wife, Oluremi, and the putative survivor (names withheld), according to Justice Jimi Bada of the Court of Appeal, Lagos Division, who read the lead judgement.
According to the appellate court, the lower court should not have relied on the prosecution’s evidence because it had significant discrepancies.
