(LATEST) MOHBAD’S DEATH: NAIRA MARLEY, SAM LARRY SUE MAGISTRATE, POLICE, DEMAND N40 MILLION

In an attempt to challenge their “continued detention” following the death of musician Ilerioluwa Aloba, well known as Mohbad, singer Azeez Fashola, better known as Naira Marley, and one of his associates, Samson Eletu, also known as Sam Larry, have launched a basic rights action.

Sam Larry and Naira Marley are suing the police and Lagos magistrate Adeola Olatunbosun for N20 million in damages for what they claim is their “continuous detention” while under police custody.

The complaint was brought before the Federal High Court in Lagos, and Naira Marley and Sam Larry were added as defendants alongside the police and the Lagos magistrate.

A magistrate had ruled that Naira Marley and Sam Larry would be detained by the police for 21 days in connection with the death of Mohbad, a 27-year-old who passed away earlier in September.

But according to Channels Television, Olalekan Ojo (SAN), the attorneys for Naira Marley and Sam Larry, both defendants, are pleading with the court to rule that their ongoing detention “at the Homicide Section of the Lagos State Police Command, Panti, Yaba, Lagos State, since October 4, 2023” violated their rights.

They contended that the magistrate’s order of remand, which was only for 21 days, had passed. Their request is for “a court order releasing the applicants forthwith.”
