N80.2BN: JUDGE’S ABSENCE STALLS HEARING OF EFCC’S CASE AGAINST YAHAYA BELLO

On Monday, the planned hearing for the appeal filed by the Economic and Financial Crimes Commission in the Court of Appeal, Abuja division, to overturn the Kogi State court order prohibiting the anti-graft agency from apprehending, holding, and bringing charges against the state’s immediate former governor, Yahaya Bello, was postponed.

The Federal High Court in Abuja’s Justice Emeka Nwite granted the EFCC an arrest warrant so they could charge Bello, as they were dissatisfied with the restraining order.

When granting the arrest warrant, Justice Nwite declared, “The following order is hereby issued:

That an order of this honourable court is hereby made directing and/or issuing a warrant for the immediate arrest of the defendant to bring him before this honourable court for arraignment.

ā€œThe case is adjourned until April 18 for arraignment.ā€

Bello is being charged with nineteen counts by the EFCC, which include suspected money laundering, breach of trust, and theft of funds totaling N80.2 billion.
But because the EFCC was unable to apprehend Bello, he was not present in court on Thursday, April 18, for his arraignment.
In court, EFCC attorney Kemi Pinehero (SAN) asserted that he was taken away by an individual who was granted immunity.
In a suit designated CA/ABJ/PRE/RDA/CV/165MI, the EFCC is identified as the appellant and Bello as the only defendant.
Because it is an organisation established by legislation to carry out tasks outlined in its Establishment Act and has the authority to look into and prosecute economic crimes as defined by sections 6 and 7 of the Economic and Financial Crimes Commission Act, the EFCC challenged the Kogi court ruling in the appeal.
