
EDO POLL: APPEAL COURT REAFFIRMS IGHODALO AS PDP GOVERNORSHIP CANDIDATE
The Court of Appeal in Abuja has reaffirmed Asue Ighodalo’s candidacy as the Peoples Democratic Party’s (PDP) governorship candidate in Edo State.
In a unanimous decision rendered by Justice Musali JCA in the matter CA/ABJ/CV/764/2024, the Appeal Court ruled that the delegates seeking to annul the PDP primaries lacked locus standi and that the trial court lacked authority to do so.
The Appellate Court further noted that under Section 84 (14) of the Electoral Act, only aspirants can dispute a primary election.
It stated that ad hoc delegates are not aspirants and hence do not have the right to sue because the dispute is internal to the People’s Democratic Party.
“They are delegates and not aspirants. Delegates do not have any locus to challenge the process of the primary election,” the court held
As a result, the Appellant Court affirmed the PDP’s February 22 primaries in Edo State, which produced Dr. Asue Ighodalo as the PDP’s governorship candidate in the upcoming Edo governorship election on September 21st.
