COURT OF APPEAL AFFIRMS GOVERNOR LUCKY AIYEDATIWA’S ELECTION IN ONDO STATE

The Federal Court of Appeal sitting in Akure, Ondo State, has upheld the election of Governor Lucky Aiyedatiwa, affirming his victory as the duly elected governor in the November 16, 2024, governorship poll.
Aiyedatiwa, who contested on the platform of the All Progressives Congress (APC), was declared winner by the Independent National Electoral Commission (INEC) after polling 366,781 votes and securing victory across all 18 local government areas of the state. He defeated his closest rival, Agboola Ajayi of the Peoples Democratic Party (PDP).
Thursday’s appellate court ruling follows earlier legal triumphs for Aiyedatiwa at both the tribunal and the Supreme Court.
On June 4, 2025, the Ondo State Governorship Election Petition Tribunal, led by Justice Benson Ogubu, dismissed petitions filed by Ajayi and four other parties the Social Democratic Party (SDP), African Democratic Congress (ADC), Allied Peoples’ Movement (APM), and African Alliance (AA) citing lack of merit. The tribunal upheld the legitimacy of Aiyedatiwa’s election and declared that the petitions failed to provide substantial evidence of electoral irregularities.
Earlier, on March 11, 2025, the Supreme Court dismissed a separate pre-election appeal filed by Ajayi challenging the eligibility of Aiyedatiwa’s candidacy. The apex court ruled that the suit was filed outside the statutory time frame and that Ajayi lacked the legal standing to question the internal affairs of the APC, including the nomination of Aiyedatiwa’s running mate.
With the Appeal Court’s latest decision, Aiyedatiwa’s electoral mandate stands fully validated, reinforcing his position as the governor of Ondo State.
