FUBARA IMPEACHMENT COURT ORDER “IN CLEAR BREACH OF CONSTITUTION” — LAWYER

A lawyer, Godspower Egbule, has stated that courts lack the constitutional power to interfere in impeachment proceedings, describing a recent court order on the matter as a “flagrant disobedience” of the Constitution.

Speaking to the media on Monday, Egbule said the House of Assembly had, to the best of his knowledge, followed all legal requirements in the impeachment process, adding that responsibility now rests solely with the Chief Judge.

Citing constitutional provisions and judicial precedents, he emphasized that courts are prohibited from entertaining impeachment-related matters at certain stages. He referenced a Court of Appeal ruling in a case involving former Abia state deputy governor Enyinnaya Abaribe, which reinforced that courts do not have jurisdiction over impeachment processes at specific points.

Egbule warned that any court order attempting to halt or interfere with impeachment proceedings would constitute a direct violation of the Constitution.

He said:
“The House of Assembly, to the best of my knowledge, has followed the law in these impeachment proceedings. The process now rests with the Chief Judge. Courts do not have jurisdiction to entertain matters of this nature at this stage. Even in the Abaribe case, the Court of Appeal affirmed that no court could intervene once the impeachment process had begun. Operating by the Constitution, that recent court order is a flagrant disobedience of its provisions.”
