APGA URGES IMO HIGH COURT TO HALT SEPTEMBER 26 COUNCIL ELECTIONS

The All Progressives Grand Alliance (APGA) has approached the High Court of Imo State, Owerri Judicial Division, seeking an order to stop the Imo State Independent Electoral Commission (ISIEC) from conducting the local government elections scheduled for September 26, 2026.
In Suit No. HOW/1380/2026, filed on September 16, APGA and four members of its state executive are seeking an injunction restraining ISIEC and its chairman from proceeding with the election pending the determination of the substantive suit.
The plaintiffs argued that ISIEC’s 360-day Notice of Election issued on September 18, 2025, was defective because it failed to state the date of the election, allegedly contrary to the provisions of the Electoral Act.
They further contended that ISIEC’s announcement on September 11, 2026, fixing the poll for September 26 was made too late and could not correct the alleged shortcomings in the earlier notice.
APGA relied on a 2025 Supreme Court judgment concerning the Rivers State local government elections, arguing that statutory requirements, including the issuance of a valid Notice of Election and provisions relating to the voters’ register, must be strictly complied with.
The plaintiffs also argued that the Electoral Act 2022, under which the 2025 notice was issued, had been repealed by the Electoral Act 2026, which came into force in February.
They further questioned whether ISIEC complied with the statutory requirements governing the Register of Voters, particularly the provision requiring a 90-day period for the cessation of voter registration and revision.
