The Court of Appeal in Lagos dismissed the appeal filed by the actress which challenged Lagos High Court judgement sentencing her to five years in prison for the death of Dr. Giwa Suraj.
The Court of Appeal had reserved ruling on the appeal filed by the actress In January because she was not in attendance.
According to The Nation, Ibinabo was initially given a fine of N100,000 by Chief magistrate O.A Isaacs for her reckless driving in Lekki, Lagos, which led to the death of a doctor, Giwa Suraj in 2006. But the Lagos State Attorney-General and Commissioner for Justice, Olasupo Sasore (SAN), was unsatisfied with the judgement and appealed it at the Lagos High Court.
The actress was then slammed with a five-year sentence which she challenged at the Court of Appeal, asking that they revert to the Magistrate Court ruling.
Today, the appellate court dismissed her appeal and affirmed the High Court’s judgment. The Nation reports that the unanimous decision was delivered by Justice Jamilu Yammama Tukur, adding that the Magistrate Court lacked the jurisdiction to grant Ibinabo an option of fine.
The former beauty queen today burst into tears as the judgement was read, and her lawyer Nnaemeka Amaechina, said that today’s ruling will be challenged at the Supreme Court, that a Notice of Appeal had already been filed.
