
COURT GRANTS NNAMDI KANU ACCESS TO PRIVATE DOCTOR OF CHOICE

On Thursday, Justice Binta Nyako of the Federal High Court granted the detained IPOB leader Nnamdi Kanu’s appeal for permission to see the doctor of his choice while under the care of the State Security Service.
The court ruled that Kanu has the right to see any doctor of his choosing, but noted that Kanu should be responsible for covering those costs.
Kanu should pay for his own medical examination while he is in the DSS’s custody for an investigation, according to Justice Nyako.
Kanu has asked for an order of mandamus in the lawsuit he has filed through his legal team, which is led by Prof. Mike Ozekhome, SAN, to compel the security agency to give him unrestricted access to his private physicians.
The plaintiff had asked the court for a mandamus order ordering him to the doctor’s office with his documents.
The court ruled that Kanu is entitled to access to his medical records and that the DSS should respect this right.
The court further ruled that Kanu’s medical examinations performed outside of a DSS facility should be overseen by his personal medical staff and that the records should be kept confidential for security reasons.
While ruling on the application justice Nyako said that the “the Application on the whole succeeds and is hereby granted”.
