TRIBUNAL UPHOLDS NED NWOKO’S VICTORY, ORDERS RERUN IN WARRI SOUTH LGA

The Delta North Senatorial Election was held on February 25, 2023, and the Peoples Democratic Party (PDP) candidate, Senator Ned Nwoko, was declared the winner by the National and State Houses of Assembly Election Tribunal, which is located in Asaba, the capital of Delta State.

Ken Kanmma of the Labour Party (LP) filed a petition, which the three-person tribunal led by Justice Catherine Ogunsola dismissed for lack of merit.

In its unanimous decision, the Tribunal found that the petitioner had failed to establish his case since he was unable to present any pertinent documents to support the allegations of non-compliance made in the petition.

Additionally, the Tribunal rejected a complaint brought by Senator Peter Nwaoboshi on behalf of the All Progressive Congress (APC) against Nwoko. The Tribunal dismissed the case and fined the petitioner N500,000 in the process.

A challenge filed by PDP candidate Michael Diden challenging the win of APC candidate Joel Onowakpo-Thomas in the Delta South Senatorial District election was also granted by the court, which ordered INEC to hold a supplementary election within 90 days.

Diden and his party asked the court to overturn INEC’s declaration that Onowakpo-Thomas would be the next senator on the grounds that he “was not duly elected by a majority of lawful votes cast at the election and that his election was invalid due to non-compliance with the provisions of the Electoral Act, 2022.

The petitioners, among other things, are requesting that the Tribunal issue an order requiring it to compare the results of the election held in the Warri South Local Government Area to the legal votes recorded in support of the parties and pronounce the election’s victor based on the comparison.

Because the Tribunal agreed with the petitioner’s assertion, it only ordered a rerun in the Warri South council, where the election was purportedly called off.
