PRESIDENTIAL TRIBUNAL: FCT HAS NO SPECIAL STATUS, NO ELECTRONIC COLLATION OF RESULTS – INEC SAYS
By Aishat Momoh. O.
The Independent National Electoral Commission stated in its final written address on the PDP’s petition that the FCT has no special status.
Abubakar Mahmoud, counsel to INEC, stated that giving special status to voters in the FCT over voters in other states is ludicrous.
The PDP’s position that the candidate must win the FCT in order to win the presidential election violates Section 299 of the constitution.
According to Section 134 of the Constitution, the FCT is considered a state; thus, the country has 37 states.
Concerning the transmission of results, the commission noted that the petitioners imagined an electronic collation method.
An electronic collation system does not exist.
Although there were unavoidable problems that hampered the transmission to IREV,
The petitioners were unable to demonstrate that the malfunctions had an impact on the election’s outcome.
INEC has asked the court to reject the PPD petition for lack of merit since the petitioners have failed to fulfill the burden of proof imposed by law.
