ADC BLASTS INEC CHAIRMAN OVER ‘MISAPPLICATION’ OF LAW

The African Democratic Congress (ADC) has criticised the Chairman of the Independent National Electoral Commission (INEC), Prof. Joash Amupitan, over his recent interview, describing his remarks as legally flawed.
In a statement issued on Friday, the party’s National Publicity Secretary, Bolaji Abdullahi, said the INEC chairman’s comments reflect a misunderstanding of constitutional provisions and judicial rulings.

Abdullahi argued that Amupitan’s repeated claim that INEC is operating within a multi-party constitutional framework sidesteps the real concern. According to him, the issue is not whether Nigeria is a multi-party state in principle, but whether INEC’s actions are, in practice, limiting the ability of opposition parties to organise and function effectively.
He clarified that the ADC has not suggested that multi-party democracy has been abolished, but rather that certain actions are weakening it in reality. He also noted that citing the existence of multiple political parties does not adequately address the concerns raised about the commission’s conduct.
On the Court of Appeal’s directive, Abdullahi faulted Amupitan’s reliance on the doctrine of status quo ante bellum, saying the interpretation was selective and inaccurate. He explained that such preservation orders are meant to maintain the subject of litigation, not to halt the internal operations of political parties.
