EJIMAKOR OUTLINES NEXT STEPS IN NNAMDI KANU’S APPEAL AT THE COURT OF APPEAL

Aloy Ejimakor, counsel to Nnamdi Kanu, the convicted leader of the Indigenous People of Biafra (IPOB), has given an update on the progress and next steps in his client’s appeal at the Court of Appeal.
In a statement shared on X on Wednesday, Ejimakor disclosed that Kanu’s Notice and Grounds of Appeal were filed in February 2026, formally setting the appellate process in motion.
He further noted that the record of appeal—including the charge sheet, court proceedings, exhibits, rulings, judgment, and sentence—has been compiled by the registrar of the Federal High Court, Abuja, and forwarded to the Court of Appeal.
According to him, the next phase will involve the submission of briefs of argument.
He explained that Kanu’s legal team is required to file its appellant’s brief within 45 days of receiving the record, detailing arguments across 22 grounds of appeal and seeking to overturn the conviction.

He added that the Federal Government, as the respondent, will have 30 days to file its brief after being served, while the defence may submit a reply within 14 days if necessary.
Ejimakor noted that these briefs will constitute the main substance of the appeal, with oral submissions during the hearing limited to clarifications, emphasizing that no new evidence or witness testimony will be introduced at this stage.
He further stated that once all briefs have been filed, the Court of Appeal will set a date for the hearing, where a three-member panel of justices will listen to arguments from both parties.
After the hearing, the court is expected to reserve its judgment, which may be delivered within a few weeks or months, but not exceeding 90 days.
He outlined possible outcomes to include the court allowing the appeal and overturning the conviction, dismissing the appeal and affirming the judgment, or ordering a retrial.
“People should focus on these clearly defined, sequential stages instead of getting caught up in daily rumors or assuming that the appeal will follow the same procedures as the High Court under Justice Omotosho.
“This is the standard, transparent process established by Nigerian law, and Nnamdi Kanu’s appeal will follow the same framework. The appeal is moving forward exactly as the rules prescribe—one procedural step at a time,” Ejimakor said.
