UBA LOSES COURT CHALLENGE AGAINST FCCPC JURISDICTION

A Federal High Court in Abuja has dismissed a lawsuit filed by United Bank for Africa Plc challenging the authority of the Federal Competition and Consumer Protection Commission to investigate complaints involving banks.

Delivering judgment on Tuesday, Justice James Omotosho ruled that the commission has legal backing to handle consumer protection and competition-related issues involving financial institutions.

The suit, marked FHC/ABJ/CS/1972/2025, questioned whether the FCCPC could exercise jurisdiction over commercial banks licensed by the Central Bank of Nigeria, particularly in relation to banking services and financial products.

In reaching his decision, the judge examined provisions of the Nigerian Constitution and the Banks and Other Financial Institutions Act cited by the plaintiff.

Justice Omotosho held that the FCCPC’s mandate extends to consumer complaints within the financial sector, affirming its oversight role alongside existing banking regulation.

The court also ordered UBA Plc to pay a N2 million fine, describing the case as frivolous and lacking merit.

Reacting to the judgment, FCCPC Executive Vice Chairman and Chief Executive Officer, Tunji Bello, welcomed the ruling.

In a statement issued through the commission’s Director of Corporate Affairs, Ondaje Ijagwu, Bello said the decision strengthens consumer protection efforts and offers legal clarity on the relationship between sector regulation and consumer rights enforcement.
