COURT ORDERS FCT WORKERS TO SUSPEND STRIKE FOLLOWING SUIT BY WIKE

The National Industrial Court of Nigeria, sitting in Abuja, has granted an interlocutory injunction compelling workers under the Joint Union Action Committee (JUAC) in the Federal Capital Territory to suspend their ongoing strike.

The injunction followed a suit filed by the Minister of the Federal Capital Territory, Nyesom Wike, and the FCT Administration against the Chairman of JUAC, Rifkatu Iortyer, and its Secretary, Abdullahi Umar Saleh.

In the suit marked NICN/ABJ/17/2026, the claimants sought an order restraining the defendants, their agents, and affiliates from embarking on industrial action, picketing, or any form of lockout.

Delivering his ruling on Tuesday, Justice E.D. Subilim held that although the matter constituted a trade dispute and had met the legal requirements for industrial action, the right to strike was not absolute once a dispute had been referred to the National Industrial Court.

The judge ruled that workers are prohibited from embarking on or continuing a strike after a dispute has been brought before the court, stressing that any ongoing industrial action must cease pending the determination of the case.

“An order of interlocutory injunction is hereby granted, restraining the defendants and their representatives from further embarking on any industrial action against the claimant,” Justice Subilim ruled. “This order shall remain in force pending the determination of this suit.”

The court adjourned the matter until March 23, 2026, for the hearing of the substantive suit.
