The Supreme Court of Nigeria has overturned the status quo ante bellum order earlier issued by the Court of Appeal of Nigeria in Abuja regarding the leadership dispute within the African Democratic Congress.
The ruling effectively restores the executive committee led by David Mark following its removal from recognition by the Independent National Electoral Commission.
In a unanimous judgment delivered on Thursday, a five-member panel headed by Justice Mohammed Lawal Garba ruled that the Court of Appeal’s order was unnecessary.
The apex court also held that the appeal challenging jurisdiction was based on an ex parte order directing parties to show cause, without first obtaining the required leave from the appellate court.
