The Supreme Court has reserved its judgement in the contentious appeal challenging the outcome of the Edo State governorship election, which produced Senator Monday Okpebholo as governor.

The apex court, after hearing arguments from all parties involved on Tuesday, adjourned judgement sine die, indicating that a date for the ruling would be communicated later. The proceedings were presided over by Justice Garba Lawal.

The appeal was filed by Asue Ighodalo and the People’s Democratic Party (PDP), whose counsel, Senior Advocate of Nigeria (SAN) Ken Mosia, urged the court to nullify Okpebholo’s election and declare Ighodalo the rightful winner. Ighodalo claimed he polled the majority of lawful votes in the election.

However, the Independent National Electoral Commission (INEC), represented by Kanu Agabi, SAN, countered the appeal, urging the court to dismiss the case entirely. Agabi pointed out that the petitioners had earlier described the election as invalid and unlawful due to alleged non-compliance with the Electoral Act 2022.

INEC argued that Ighodalo and the PDP could not, on one hand, claim the election was illegal and on the other, request to be declared winners of the same process. The electoral body accused the appellants of inconsistency and maintained that their petition lacked merit.

The Supreme Court will communicate the date for judgement at a later time.
